I feel like some of you guys get your legal analysis from Elie Mystal.
From Yale Law Professor Jed Rubenfeld.
I’ll accept his analysis over the Board Barristers here.
“ Should a former president be immune from prosecution after leaving office? Believe it or not, we had no law on that issue for two hundred years. There didn’t need to be any: until now, no former president had ever been criminally prosecuted for actions taken during his presidency. But Trump is being prosecuted for (among other things) his involvement in January 6, so the immunity issue had to be confronted.
Trump’s lawyers argued for complete immunity. The special prosecutor, Jack Smith, argued for zero immunity, and the D.C. Circuit basically adopted the prosecution’s position. The Supreme Court rejected both extremes, laying down a new test for presidential immunity and giving something to both sides.
At its most simple, the Court’s new test first asks whether the conduct in question was an “official” act—i.e., an exercise of the president’s powers. If it was not an official act, then there’s no immunity at all. If it was official, the next question is whether the president was exercising a “core” constitutional power. If so, then there’s complete immunity—no prosecution is permissible. But if we’re dealing with an official act outside the core, then “presumptive” immunity applies—the president will be presumed immune unless the prosecution can rebut that presumption. What does that mean? Well, no one knows exactly, because it’s new law.
It will now be up to the lower courts to apply those standards”

Yes, MOR, but that presumptive immunity must be a problem, right? Got to be impossible for a prosecutor to overcome, no? I mean, for example, we would NEVER have penitentiaries full of prisoners all over the country if normal citizens were presumptively innocent in criminal court proceedings!

What's going on today? End of Biden? His odds to win the Presidency have moved from +250 to +450 in the last several hours. His odds of being the Dem nominee have moved from -250 to -140. The bad news? The overwhelming favorite to succeed him as nominee is none other than Cackles herself, Kamala Harris.

Of that group, in a hypothetical matchup, Obama is the only one favored to beat Trump. She is a -175 favorite. Trump is only a slight -130 favorite over Newsom, but he's a massive -300 favorite over Cackles.
I say bring on the third term of Obama (really the 4th since Barack is pretty mucn pulling the strings through this admin).

I don't know how the Dems ended up being stuck with Biden and Harris again, but they are the only two I can imagine being incapable of beating Trump. Just using the betting odds to go down the list, I think every single every other person would beat Trump if they had been "selected" instead of Biden/Harris (because no one was voted into this):
Gavin Newsom - awful but easily beats Trump
Michelle Obama - would win 40+ states
Gretchen Whitmer - alive, not Harris, wins close
Hillary Clinton - she'd win easy this time
Josh Shapiro - I have no idea who that is. Good enough!
J.B. Prizker - Slightly less obnoxious rich white guy. Winner
Mayor Pete - Dominant win
Andy Beshear - 40+ state win
Raphael Warnock - OK, don't really know anything about him other than he's less stupid than Herschel Walker (low bar)
Elizabeth Warren - takes the plains states from Republicans with her Native background

No idea how much is actually being wagered, but the max bet is $500. So it's not just a jokey $25 max bet deal.
The max bet was $2500 last week. I think things are so crazy and moving around so rapidly they don't want to take crazy action on these bets right now. For example, Biden is back down to +600 in the couple of hours since I posted that he was +1100.

Happy Birthday America! Hope you are relaxing and celebrating somewhere with friends and family.
Hot here in the South today!.
Something to reflect on as our nation celebrates its 224th birthday. As Judge Luttig noted:
It can never again be said that in America “no man is above the law.” The Supreme Court held today that the President of the United States — and the former president in particular — is above the law, and the only person in America who is above the law.
(which makes me think the words above the Supreme Court entrance “Equal Justice Under Law” no longer apply in our country.)

If this has been asked and answered, sorry for the repetition, but I can’t keep track of every post in here.
For those of you saying that the SCOTUS ruling means the President is above the law and untouchable, except for being impeached, do you think the ruling should have been that the President, whoever that might be, has no immunity at all? If that was the ruling, I can envision a future where Presidents are spending a lot time defending themselves from politically motivated criminal and civil charges. The charges might not even be politically motivated. Extrapolating from the example I gave a few days ago, do we want a President to be able to be charged for murder by the family of innocent individuals killed in a drone strike while going after a legitimate military target?
There has to be some immunity. The issue is where to draw the line. The sad thing is that this even had to be brought before the SCOTUS.

The fact that the article self-describes as a "special hair-on-fire edition of TPM’s Morning Memo" tells you all you need to know. That and the the sky-is-falling hyperbole of the first few sentences makes this a very niche read.

It’s funny watching dems on Twitter whine about the medias coverage post debate.
The conspiracy theories I'm seeing from the left are down right Q-ish. CNN intentionally messed with his lighting
CNN intentionally messed with his audio. The camera angle was more favorable to Trump. Trump somehow poisoned him.

I’m not defending Biden’s horrible debate performance.
I’m worried about the future of our country. That concern is shared by very knowledgeable people, including many advisors/cabinet members of the former president.
To the question noted earlier…somehow every president before him was OK with operating within the law. It’s only this former president who has a need for some sort of immunity. That should be the enough of a red flag for anyone looking at the upending of centuries of “no one is above the law”…our foundational principle to grasp.
Has anyone here read the decision? I urge you to do so. I think it will be like Dred Scott…and decades down the road be reversed. Hopefully the country is smart enough not to elect someone who wants to be dictator/king. That’s why we have a country in the first place; we didn’t want one.

No one asked for immunity before because no one tried to prosecute a former President before. I'm sure 45 was the first President to ever commit a criminal act in office. But anyway, the Supreme Court had never had reason to address this before because the issue was never in front of them before. I'm pretty certain most Presidents already assumed they were somewhat above the law. From now on they'll know the scope of their immunity.

I think women, because she is likeable (especially vs Trump who wants to fuck his daughter and grab'em by the pussy) unlike what Hilary was back in '16.
I think African American 1.) because historically they have voted democrat, and 2.) if you've not noticed she's a minority.
My words are Kamala is stupid, and only stupid people would vote her. I do not believe blacks and women are stupid, so they will not vote for her just because they have the same minority status/gender.
So, do you not believe Kamala is stupid then? She's left a clear record that she is.

Conservatives have known this for at least a year or two, but were dismissed as conspiracies (big surprise!). This isn't just a conspiracy by the White House, it's also a conspiracy by the media and all the Democrats in DC. They knew - there is no way in hell they didn't know. And now they're doing their best to act like this all came out of left field. This is all BS - they are every bit as complicit in this cover-up as the Biden family and his handlers are in the WH.

Democrats have also held the Senate the majority of the past 80 or so years.
The affiliation of the POTUS has been relatively even.

Yes Ivermectin was developed as an animal medication and two years later became an important therapeutic for humans. Especially impoverished countries.
The drug has shown promise for humans in various disease states. The reason people were somewhat optimistic about using it with covid was because of its anti inflammatory properties. As you know, a lot of complications with covid were due to excessive inflammation.
Quite few older drugs become better with time the more we understand physiology and different pathways. From my perspective, for those calling it just a horse dewormer are being pretty ignorant (not pointing finger at you).
BTW, FDA is still reviewing its potential roll in treating covid. However, don’t ever seeing it approved.

Kelly wasn’t even near Trump when he allegedly said it. Guess what?
Goldberg has never published a single word on this “story” since his original one.
Yeah. Hoax. Just like Charlottesville.
By the way. Kelly was definitely not a fan of Trump. He has defended Alexander Vindman who was the “whistleblower” on the phone call between Trump and Zelensky- even though Vindman wasn’t in that room either, and who has proven to be a highly Dem biased actor.

It just amazes me that people will go to lengths to defend Biden and Trump. Like what loyalty have they shown you to back their every comment and move? ItÂ’s ok to say both arenÂ’t fit to be president. ItÂ’s ok to want better than two old out of touch rich men who honest donÂ’t care about you. Maybe discuss actual solvable problems like congress term limits, age restrictions for running for president, gerrymandering, Red Dye 40 and other artificial colors and sweeteners in food, PBMs causing pharmacyÂ’s to close at an alarming rate. Sorry, now back to the constant bickering about which old man is least worst.

Agree with all of what you said, especially the bolded part. I got two buddies that work at separate flavoring companies. They have both told me you wouldn't believe some of the crap that is put into our food/drinks here in America.
One of my buddies shared with me to never drink Prime or any of the other brands that company makes---basically just drinking cancer right out of the bottle.

Hmmmm. Even the Democrats deny anonymous sources when it comes to Biden.
I’ll go with the fact that Kelly wasn’t there and that he only cited the unnamed sources in Goldberg’s piece- the piece that, despite promises of providing backup, Goldberg never has.
From the Wall Street Journal today re: Biden at a NY Fundrsiser:
“ During a fundraiser at the Four Seasons in New York in June 2023, Biden spoke for five to 10 minutes and then took a few questions, said attendees who bought a ticket. They were struck by how fragile he seemed. At one point, Biden couldn’t recall the word for “veteran.” The president asked the group to help him find the word, saying he wanted to refer to a person who had served in the Army or Navy.
Asked about these events, Kevin Munoz, a Biden campaign spokesman, criticized reporters who used anonymous sources to recount the president’s behind-the-scenes interactions.”
Sad times when one can be duped by an Altsheimer patient and a 50 plus year lying politician.

Louisiana is now requiring that all public schools display the Ten Commandments in their classrooms. This has set off a hornets nest, which I kind of get, but here's what I don't get.
Gov. Jeff Landry ACTUALLY said this...
“If you want to respect the rule of law, you’ve got to start from the original lawgiver, which was Moses” who got the commandments from God, Landry said.
Article link: https://apnews.com/article/louisiana-ten-commandments-displayed-classrooms-571a2447906f7bbd5a166d53db005a62
What should draw criticism from EVERYONE is the brazen ignorance of this statement. Moses was NOT the first law-giver. There had been written laws for at least a thousand years before Moses is believed to have lived. I mean...if you're going to profess to know what's best for schools, shouldn't it look bad to everyone if this person comes off sounding like they themselves need to go back to school??

Representative Greg Landsman was on with Scott Sloan this morning on WLW. Apparently, he’s going to be on a call today with other Dems discussing Biden. I did not catch all of the conversation, but Sloanie kept asking if Landsman thought Biden was mentally and physically capable of staying in office and being reelected. The only answers he could get revolved around Trump. He kept trying to get back to his question and Landsman kept going back to Trump. Not really surprising.
The same thing happens here on both sides. Deflection is the norm.

I don't think most Democrats who want Biden to step aside are all that concdrned about his mental and physical abilities. They realize that he has limitations, but that's not really what concerns them. What ACTUALLY concerns them is that they are realizing that he will lose to Trump. And...they are correct.

I highly doubt Jewish, Muslim, Hindu, or any other type of different religion make much of a percentage of his constituents. I am sure he is from a very conservative area which probably would admit this is a bit too much but what is the alternative? They won’t vote for a democrat and the only other option is this guy. -Joe’s relationship with Hunter in off-shore business relationships with bad actors like China?

The plan was never for Biden to serve a full second term. All the Washington swamp Dems knew it. They wanted Biden to beat Trump, then after inauguration at some quick point, they’d force a resignation and install Cackling Kamala as the first woman of color President without having to go through the nuisance of “Democracy” by having her duly elected- which, by her disapproval ratings, ain’t happening.

I think it's always the right of the voters to question the competency of their candidate, especially mental competency.
So, I think it's up to Biden to address the concerns, allay them or step aside.
Similarly, I'm struck by the total abdication of this duty by the Republicans.
While leading Democrats are questioning Biden's situation and it dominates the news, I never hear of Republicans questioning:
- why they have a convicted felon on the ticket
- why he has no policy proposals and spends his time at rallies fear mongering
- questioning his mental competency as he wonders all over making no sense about sharks, and electric boats, and other nonsense

Not sure that answers why there is no one questioning the points I raised on the Republican side. He wasn't a convicted felon before the primaries.
But, you're probably thinking he had all the indictments then...and you'd be correct.
I've voted Republican in the past, but the party I knew would have never supported a felon or someone who urged followers to stop the people's business by violence. And I haven't voted for a national candidate of the party for a long time, since I think the economics of supply side , massive tax cuts and unfunded wars they gave the country, put us in a fiscal hole that will burden my grandchildren maybe forever.

Yes, Dems have added to the debt, often to pull us out of a hole like 2008 and 2020. And Clinton screwed up signing Glass-Steagal repeal.
But he left a surplus behind, and we could have started paying down the debt instead of a massive tax cut followed by unfunded wars.
I certainly don’t want Trump back in to have another tax cut, primarily benefitting the well to do, and adding more debt.

Spot on. If they thought Biden would win, there’d be no talk about his mental decline and the media would still be covering it up. They can’t hide behind the “fake video” claims of his press secretary any more.
It’s the same reason the media is now actually talking about Biden’s decline. The public is now painfully aware of their dereliction of duty by not accurately reporting about Biden.
I still remember CNN and MSNBC parading out mental health professionals during Trump’s first term after his “covfefe” tweet. They were talking about how it might be time to invoke the 25th amendment. Strange how the media had been so silent about Biden.

Until we get a viable 3rd party, we’re stuck with this primary process that rewards those who pander to the extremes of their respective parties. A middle of the road candidate, which I think would appeal to most voters, stands no chance in our current system.

The rest of the world is pretty self explanatory. It matters because one of these two jokers will be president for another four years and international policy and relations is kind of a big deal.

So, I think it's up to Biden to address the concerns, allay them or step aside.

Horse dewormer. That’s what the Dems (aka, government parrots) called Ivermectin. Ivermectin, a long-proven safe drug with anti-viral properties that showed clear effectiveness in reducing Covid symptoms. The CDC, who is totally bought by Pfizer et al, had to quickly brush it under the rug. Why? Because it could greatly reduce their vax profits. Do the math from there.

I have questions:
First of all, I am so fucking proud to be a Trump supporter. If you don't understand the bond his supporters have with him and his populace movement of opposing the globalist elites, after his reaction last night, then you're probably a lost soul.
Anyway, I have questions:
1) The first is obvious as all hell: How did the Secret Service not have anyone atop the AGR building from where the assassin acted?
2) Where did the assassin receive his training? There's no way someone off the street could fire a rifle like that, with that amount of accuracy, without training. Dan Bongino suggested that he may have hurried his shot because several people were yelling of his presence.
3) In the video below, you see the counter snipers atop the building immediately on Trump's flank. Apparently these were the guys that delivered the kill shot. Presumably, how did they not see what so many others saw from their elevated vantage point?
4) On the flipside, they DO appear to be alerted to the assassin. If you watch the video closely, it looks as if they began firing on the assassin almost at the same time the assassin started firing. This begs two questions: (a) why did they presumably wait so long to act, and (b) for how long were they aware of the threat, and why didn't they send out an alert?
I'm not alleging anything, I just need answers. Unfortunately, I don't think we'll ever get any straight answers. [Jack Ruby] has already shot [Oswald], and the corrupt, Trump-hating DOJ/FBI/CIA's [Warren Commission] will likely be a cover-up.

Political hate at an all time high in this country? Check
Is anyone really surprised this has happened? Especially in an outside event? I’m actually surprised this doesn’t happen more often with the amount of political hate, access to weapons, and mental health issues that plague this country. It would be nice if we could actually focus on the issues at hand and how each of these candidates will address these issues. Instead of the constant name calling that does nothing for this country except divide and cause Americans to hate each other. This would be a great time for politicians on both sides to until together to stamp this type of hate out but I won’t hold my breath on it.

I suspected I'd have to connect the dots for you.
2020: Ivermectin was a long-proven safe drug that had potential to lessen the effects of Covid. There was not yet the chance to study if it did or did not show any effectiveness against Covid. Why would it need to be degraded by labeling it "horse dewormer"? Why would idiots like some here parrot that phrase when they had no idea? The studies were conducted because it has potential, and they took place after the "horse dewormer" propaganda. They are, therefore, irrelevant to my point. Hopefully that helps.
By the way, the studies showed some (albeit limited) effectiveness, and Ivermectin is still completely safe. Would we have been at least slightly better off if Ivermectin were widely used? You know the answer.
You are slow on the uptake, but way too quick on the output. Think more, post less.

The shooter took the gun from his father, who legally purchased it. Is there proof the shooter was mentally ill?
Think more, post less.

I mean he just tried to assassinate a major party nominee.

Yeah you’re right. Mentally healthy people try to assasinate a presidential candidate.
Does because his father got it legally mean we don’t have a gun problem?
You just need to think and not post at all.

Think more, post less.
it is horse dewormer. It also has some antiviral effectiveness in humans, not covid.
If it was widely used it would have done nothing, because it wasn’t effective which I pointed out in a clear concise manner.
That’s like saying had everyone worn masks appropriately, would we have been more slightly better off. I think you know the answer
You have a habit of thinking you are a lot smarter than you actually are

I was thinking about that last night. Kind of amazing there hasn’t been attempt since ‘81. That’s a long time ago.

Yeah for president to get shot. Some seven years ago a deranged shooter shot at Republican lawmakers during baseball practice. Almost killing the majority whip.

Didn’t that get brushed under the rug with it being “officially” determined to be suicide by cop, instead of a nut job trying to kill Republicans?

I imagine if you hear over and over again that Trump is "Hitler", a threat to the existence of democracy, evil, horrible, satan, then someone might take those thoughts to heart and do something about it.
Joy Behar, Gary Griffen's sister, and the View probably feel justified in their drama names.

Yeah by the FBI but Alexandria prosecutors called it terrorism on their findings. What a joke by FBI. Think it was originally a McCabe case which tells you something.
Look at shooters social should give you a clue on his motives. Also when he got to ballpark, asked which team was practicing. After hearing rebubs, he went to his van to get his gun. If he really wanted to get killed by a cop, just point it at them.

It's been over 24 hours since Trump was shot, so I figure the new talking points memo must be out. I thought we'd have seen the gist of that posted here by now.

I’m concerned that some “college educated” people are so flippant about what happened.
Not you GO.
A former President of the United States of America and current front runner was within an inch of being killed.
No, it isn’t the guns fault. It’s ours.

I’d say the gun helped. Seems like Trump would have to be pretty spotty in the heart to be injured by the guy yelling bang at him from 150 yards away. (Credits to Eddie Izzard)

Yes the mentally unstable person who had access to a gun is what happened. Rinse and repeat. Maybe you haven’t noticed but it’s been an issue for a long time now. An issue our politicians refuse to fix for various reasons.
“Ours?” F no. It’s our moron politicians.

You’re an idiot.
I basically grew up on a farm. We had plenty of shotguns.
Doesn’t mean we don’t have a gun problem in our country, and doesn’t mean we don’t have severe mental health issues in this country.
“Respect your firearms” —- you’re part of the problem for having your head buried in the sand.
Good thing his dad respected that firearm. I guess the kid did too, he used it after all. Doing what it’s intended for… shooting
I guess we can all be thankful he had access to the gun though. Otherwise the mentally unstable kid would have used the bomb materials in his car.

People simply do not understand the founders concept of the people v government focus of the 2nd Amendment. Obviously there was no ability to foresee weapon tech advancement......so a "well regulated militia" Constitutionality is meant to establish EQUAL means of force.
How this Constitutional right has been violently deformed in the fabric of our nations mentality is a completely different situation.
