So, it happened on the same date? Why are these charges just coming up now? I'm no expert, but obviously there's nothing about this I like. Certainly hoping he gets cleared and things can move on. And what is it with all the phones???

Just keep throwing it against the wall? I'd love to ask her attorney why this wasn't brought up at the same time. We've been through a nightmare recently with a son's psycho ex-girlfriend. I'm not saying that's the case here, but I had no idea it could be so awful.

In the summer between my sophomore and junior years at X, I was charged with criminal damaging. It came about because of accidental damage to a car, driven by a friend, but owned by his dad. A simple slap to the top of the car by my hand resulted in a dent that I (and his son) didn't know about at the time. A phone call by his dad to me (after finding the dent and questioning his son) which had me at an incorrect place, at a time I wasn't near there, resulted in me denying that it was me that caused the damage. A simple bit of confusion that was later rectified, but in the meantime he went to the local police and they told him to file a criminal complaint. After having papers served to me, I contacted his son and we figured out what was going on. But we still had to go to court. I agreed to pay for the damage that had occurred, his dad dropped the charges, the judge agreed, and we all went on with our lives.....with no record or punishment.
My point being......it could just be that the dad just wants the phone paid for, and agrees to pay for the damage, the case may well be dismissed with no finding of guilt or innocence, and no further problems for anyone.

I'd love for that to be the case, but if possible I think this would have gone away already. This sounds like a young lady full of venom. Just my guess.
I don't know her, and I don't know what happened but from what I can tell she may have a reason for her venom IF Myles broke two of her phones and she needed to get a protection order against him.
It sounds to me that Myles is a tad childish when it comes to relationships with the female gender and he should stay away if he can't handle himself like a man.
That certainly could be. The odd part is it could be "a tad childish" as he looks like he could be Bill Russell's younger brother. Hoping for the best on all fronts, not just legal and eligibility. This is serious life skills stuff.

Eh, we all get mad, but gotta learn to control our emotions. It's part of everyday human to human life, like I've broken up with a girlfriend recently (she couldn't handle the distance), but we talked it out like adults, and didn't damage each other's stuff. I just think you have to be able to control yourself in that situation, though I'm hoping everything works out well for Myles and he can continue on with his life. I'm sure it's a crappy thing for him to be going through, and he definitely needs some support.

Just assuming all of this is true, myles has an anger problem and may need to be taught how to handle it. Second, her father (...personal attack removed by Muskie...). It's a cell phone and a dent on a car...make myles pay for it and move on. I have yet too see where he has made threatening remarks or put his hands on her. If neither of those occurred, police did not need to get involved, and this whole thing is childish on both sides.

Damaging her property in front of her could easily be taken as a threat and is not that uncommon in domestic violence cases. I obviously have no idea what actually happened, but I don't think we should be so quick to dismiss the seriousness of this entire situation.

agreed. after looking back at the first offenses, I realized that it is a bit more serious than what these additional charges are. This has been a pretty dreadful offseason.

For one of the many lawyers on the board, in a case like this would it ever get to a point where witnesses are brought in to testify?
Given where the events allegedly went down I'm sure there were witnesses. I'm just curious in these type of situations if it ever gets to that point.

That's cool and is your right, and maybe you are different in that you know Myles on a personal level. The only thing I know about any of our basketball players is that they are good basketball players, that's all...so it's a bit hard for me to go on one side of the fence or the other.

At a minimum, it sounds like Myles has a bit of an anger problem to deal with. I'd rather see him practicing 3's or free throws in the aux gym than messing around with some chick at UDF or Dana's.

Again, why is this being brought up separately if both events happened on the same day? There's just something about that that makes me wonder... I don't know what it means, but it's curious.

The next obvious question becomes is there anything else coming.
I would think that both Myles and X are praying like hell this doesn't end up in a courtroom where the details will be dug into. No matter what actually happened nothing good would come of this playing out in court.
Given the current culture of violence against women in sports the optics of this playing out in a public forum would not be good.

Part of me wonders if this is his first breakup in a serious relationship - as in, "I wanna spend the rest of me life with this person" kind of relationship. Because the first time having one of those fall through is a bitch.
But you gotta admit when the jig is up. Smash some beers, kill some terrorists in COD, and know that you're Myles Davis. Sure, your hairline is receding, but you still got a lot going for you. Leave the woman's personal effects out of it.
In fact, I cut off all communication for awhile after a breakup. It sucks, but it accelerates the healing process.

Maybe he broke her phone outside Dana's, then went with her to UDF to get a prepay as a replacement, and as soon as she bought the replacement he broke that one!
It really makes no sense why it's two separate charges when it sounds like the same event.

i thought in the original complaint there was mention that he broke multiple cell phones...could be wrong on that one though.

I remember reading that as well. It's clear this was a volatile relationship that ended badly. Hopefully for Myles it's some restitution, avoidance, counseling and it ends there for him. I posted before, if you have a fight with your wife/gf and you get pissed and toss against a wall away from your lady and it breaks that is actually criminal damage.

If he threw her phone and broke it, then he is guilty of criminal damaging. It's spelled out right there.

I liked my Android phones but both crapped out on me before their time. I have had two Apple phones and both have been great so I am with Myles in smashing those damn Android things. Maybe X can do a promotion during halftime where folks can smash their Android phones .... Too soon?😀
