"This case could well set a precedent for college and university athletics nationwide," said Sullivan. "Coaches have to abide by contracts, and other institutions have to respect those agreements. If that contract is breached, damages will be assessed. It's a simple lesson in fiduciary responsibility and contractual obligation."

Xavier could never prove damages from any of their coaches not honoring their contract. Each time a coach left Xavier has just prospered more.

X couldn't prove damages other than maybe a one year lag but the possibility of damages for future coaches might be enough of a deterent. Personally I'm all for anything that causes people to abide by contracts. If the contracts are not going to be followed then why sign them. Of course it is the schools fault for not having larger penalties for early departure built into the contracts.

Isn't that what "buyouts" are for? I'm guessing every single XU coach's contract has had terms of how each side can leave the contract.
