Millburn, N.J. police say Bobby Gonzalez, 47, was arrested Monday after reporting to police headquarters and was charged Tuesday with shoplifting and criminal mischief.
He is accused of taking a $1,400 men’s satchel from the Polo Ralph Lauren store in the Short Hills Mall on June 29.
Gerald Krovatin, Gonzalez’s attorney, was not immediately available by phone Tuesday, but he told The Star-Ledger:
“This is a misunderstanding in a series of miscommunications. Bobby had no intention of stealing anything and the bag in question never left the mall. We are going to straighten this out with all parties involved.”
Millburn police captain James Miller was not available for comment
A spokeswoman for the Essex County prosecutor’s office told the AP the shoplifting charge is a third-degree offense punishable by up to five years in jail.
Gonzalez was fired March 17 for cause after four turbulent years at the Big East school.
SNY.tv first reported that Gonzalez was fired six days after a profanity-spiced phone tirade directed at Patrick Hobbs, his boss and the Dean of the Seton Hall Law School.
“Nobody’s gonna tell me how to run my motherf—ing program. Not you, not Monsignor, not Joe Quinlan. This is my f—ing program. My f—ing program,” Gonzalez screamed, according to the counterclaim filed by Seton Hall.
Dean Hobbs hung up on Gonzalez, the document states, and the coach was fired March 17.
Krovatin is representing Gonzalez in a lawsuit over his dismissal.

I don't pretend to know the law in other states... but in the great State of Indiana, exerting unauthorized control over and item and taking it beyond all points of purchase is shoplifting. It's not usually ok as long as you stay in the mall. Surely they can come up with a better theory for the defense.

Bobby Gonzalez Is Accused of Stealing
The difficult year for the former Seton Hall basketball coach Bobby Gonzalez continued when he reported to the Millburn, N.J., police on Monday and was charged with shoplifting and criminal mischief.
Gonzalez was accused of stealing a men’s satchel worth nearly $1,400 from Short Hills Mall. His lawyer, Gerald Krovatin, said Tuesday that Gonzalez was not technically arrested and appeared at the station voluntarily.
“This is a misunderstanding and series of miscommunications,” Krovatin said. “Bobby did not intend to steal anything.”
Krovatin declined further comment. The message on Gonzalez’s cellphone said it was not accepting calls.
Seton Hall fired Gonzalez after its season ended in controversy with one player punching an opponent in the groin during a game in the National Invitation Tournament and another being arrested soon after on charges of kidnapping, robbery, burglary and possession of a weapon. Gonzalez went 66-59 in four seasons at Seton Hall, with no appearances in the N.C.A.A. tournament.
Gonzalez is suing Seton Hall for the money that was supposed to be guaranteed on his contract.
As news of Gonzalez’s legal trouble emerged on Tuesday, a buzz shot through a high school gymnasium in Indianapolis where a number of the country’s college coaches gathered for a summer basketball tournament. Coaches shook their heads in disbelief and passed around the stories on their mobile phones.

It's where I keep all my things. Get a lot of compliments on this. Plus it's not a purse, it's called a satchel. Indiana Jones wears one.

Gonzalez pleads not guilty to shoplifting
Former Former Seton Hall basketball coach Bobby Gonzalez pleaded not guilty Wednesday to shoplifting a satchel at an upscale shopping mall last month.
Gonzalez spoke during the five-minute arraignment only to verify his address in Harrison, N.Y. His attorney, Anna Cominsky, entered the plea on his behalf. Neither commented after the proceeding.
Gonzalez is accused of taking a satchel worth about $1,400 from the Polo Ralph Lauren store in The Mall at Short Hills on June 29. Police said he removed the sensor device from the satchel and walked out of the store without paying for it.
According to a police report, the Polo store manager reported that the manager of a restaurant in the mall returned the satchel. The restaurant manager said someone had come into the eatery, left the satchel with the hostess and never returned.
Gonzalez faces criminal mischief and shoplifting charges; the shoplifting charge is punishable by up to five years in jail, according to the Essex County Prosecutor's Office. Gonzalez surrendered to police in Millburn on July 5 and has not had to post bail.
Municipal Court Judge Amilkar Velez-Lopez scheduled Gonzalez's next court appearance for Aug. 27.
Gonzalez, known for his brash, aggressive style, was fired in March after Seton Hall lost in the opening round of the NIT. He sued the school over his dismissal, claiming he was fired without cause and was owed two years of salary. The case is making its way through the federal court system.
The Pirates failed to make the NCAA tournament during Gonzalez's four years, and posted a 66-59 overall record that included a 29-45 mark in the Big East.
School officials referred to several off-court problems when they announced the firing.
Guard Keon Lawrence was suspended for the first eight games last season after being arrested for allegedly driving the wrong way on a highway and seriously injuring another motorist.
Forward Robert Mitchell, kicked off the team by Gonzalez before the team's NIT game, was charged with former player Kelly Whitney with robbing several students at gunpoint later the same week. Both men are awaiting trial.
During the team's 87-69 loss to Texas Tech in the NIT, forward Herb Pope was ejected for punching an opposing player below the belt.

NEW YORK — Bobby Gonzalez is hoping for a comeback.
Whether it’s in the NBA or on TV, Gonzo is ready to go.
“I’ve got some NBA stuff going on,” the former Seton Hall coach told The New York Times after Tuesday’s Team USA practice at John Jay College.
“Or I might be in TV for a year or two. Let the smoke clear. I may get back in college someday, but I’ll wait a while.”
Gonzalez, an assistant on the American team that won a gold medal in the 2005 World University Games, sat in the stands along with several other current and former college and high school coaches, including Barry Rohrssen (Manhattan), Al Skinner (formerly of Boston College) and Hall of Famer Bob Hurley (St. Anthony).
After the practice, he chatted up several players, including Lamar Odom of the Lakers.
Seton Hall fired Gonzalez in March for cause after a controversial four-year tenure in which he compiled a 66-59 record but failed to make the NCAA tournament.
His last year at the Big East school was filled with fireworks.
In November, guard Keon Lawrence was arrested for driving the wrong way on the Garden State Parkway.
In the team’s final game of the season, a first-round NIT loss to Texas Tech, forward Herb Pope punched an opponent in the groin.

The boldface names who helped the United States win a gold medal in the 2008 Olympics will not take part in the world championships that begin Aug. 28 in Turkey. But a familiar face showed up Tuesday for the Americans’ training session.
Bobby Gonzalez, who was fired as Seton Hall coach in March, was at John Jay College as he tried to stay connected with USA Basketball. He was also an assistant for the United States team that won a gold medal at the 2005 World University Games.
“I’ve got some N.B.A. stuff going on,” said Gonzalez, adding that he had been in touch with several teams about becoming an assistant or a scout. He declined to name the teams.

Prosecutors Offer Gonzo Plea Bargain
Prosecutors have offered former Seton Hall coach Bobby Gonzalez a plea bargain in his shoplifting case.
Gonzalez is accused of stealing a $1,395 men’s satchel June 29 at the Polo Ralph Lauren store at the Mall at Short Hills (N.J.).
“The judge asked the prosecutor to put the plea offer on the record,” Katherine Carter, the Essex County Prosecutor’s Office spokesman, said by email. “We are offering him 4th degree criminal mischief which would result in probation. He has applied for Pretrial Intervention, a diversionary program that would result in the charges being dropped after he meets certain conditions. Meanwhile the case is going to the grand jury.”
Gonzalez was initially freed without bail after pleading not guilty of shoplifting and criminal mischief. Those charges carry a penalty of up to five years in prison.
Gonzalez is hoping for a comeback in the NBA or on TV.
